What do I do if my attorney dies before my divorce trial?

June 19, 2018

Question

My attorney is in critical condition in the hospital and I was told she is dying. My divorce has been going on for 2 years and we are to go to trial in July. My attorney is alone/it is her practice with 2 clerks in her office so will another attorney take over or do I have to start over?

Answer

Call your local bar association to get a referral for a new divorce lawyer. The Court should be notified and will likely grant additional time under the circumstances. You won't be "starting over" - it's called a 'substitution of counsel'.
