Question

My spouse and I reside in New York and have been separated for over a year. His car is titled and registered to him, but he is on my insurance (has had accidents before). I was advised that I could not remove him from my policy till divorce final. He has now gotten himself into another accident and the other driver suffered injuries. Am I at risk of being sued by the other driver.

Answer

Unless your name appears on the Police Report of the accident as 'owner' or 'operator' of the vehicle, you're probably not going to be named in any claim or lawsuit. Your insurance company will, however, be required to defend any personal injury lawsuit filed against your husband if he is a named 'insured' on your policy.
