Question

My doctor did not return a required form to my employer to substantiate my disability leave. I was dismissed from my job as my leave was deemed unsubstantiated. All he had to do was fill in the medical information.
Do I have any recourse for malpractice?

I currently live in NJ but my employer is in NY

It's not malpractice, but you might want to inquire as to why this happened. If it was a mere oversight, presumably you can challenge your dismissal once the letter is sent. If your doctor did not believe you were disabled, that's a different matter...
