My father pasted away four years ago for malpractice and we sued the hospital and we just settled out of court when do we receive it

Answer

The settlement money resulting from a deceased's malpractice/wrongful death action will become an asset of their estate, which must then be allocated and distributed by order of the Surrogate's court. Liens, debts, taxes and other issues will need to be resolved to the satisfaction of the Surrogate. Depending on the complexity of the issues, this can be a lengthy process, but the best person to ask would be your lawyer.
