Is it impossible to change lawyers 4 months before trial in a med mal case in New York? Not happy with current lawyer at all.
June 30, 2014
QuestionIs it unlikely a lawyer will take over a case that is scheduled for trial in 4 months? Med mal wrongful death case. Ny supreme court. Please advise.
4 months isn't much but it is possible, and maybe an adjournment can be obtained because of a substitution of counsel. If it's because your current lawyer is not being responsive to you, you could ask around and see who else might want to take over the case. It's your prerogative to have a lawyer you want, so something may have to be worked out with your current lawyer over his lien on the fee. The merits of the case will largely dictate if a new attorney wants to take it on or pass on it, at this stage.
