Is it considered malpractice if a person is diagnosed with cancer after seeing 2 specialists who misdiagnosed the person?

May 17, 2018

Question

My sister was recently diagnosed with colon Cancer. She saw 2 GI specialists over the last 2 years and both Specialists misdiagnosed her- one Dr said her colon was just lazy . Both MDs prescribed medication for constipation. Neither of them did additional testing and she was told she didn’t need follow up.
Is this considered malpractice?
Thank you in advance

Answer

It could be - I have successfully handled missed diagnosis colon cancer cases. It all depends on what her medical records say and how advanced the cancer is. Hopefully a two year delay does not mean she's at stage IV. There is a 2 1/2 year statute of limitations (much less if she was seen by City doctors) meaning if suit is not filed quickly, it could be forever barred by the courts. Make sure you act quickly.
