Is a codicil to a will legal even if it isn't signed by owner of the will?

April 30, 2018

Question

As part of my research for a book, I need to know if a codicil to a woman's will can be enforced if she dies before signing it. The family of the woman have agreed that they want to honor her request. If it can be honored, I also need to know if the same codicil can then be reversed and made void if a situation arises that would deem the codicil unadvisable.

Answer

A codicil not properly executed (and witnessed) would be without legal effect.
