Question

One court held that this procedure does not have benefits and judge criticized it. I got hurt by the procedure. Can such opinion be used to prove either lack of benefits or perhaps unnecessary surgery? Or in what way that decision may be helpful in a lack of informed consent claim?

Attorney Johnston gave you very good advice. You should read the "decision' very carefully, because you might find that there was expert testimony about the dangers involved in the "procedure" in that case, (it would help if you said what procedure it is you're talking about.)
