Question

On or around 07/08 I was misdiagnosed with Lyme Disease, I went to the hospital BC half of my face went numb. I was feeling tingly in my fingers and face and boom - couldn't move half my face. Pretty scary. The doctor didn't bother with running any tests on me before diagnosing it as Lyme Disease. Fast forward to 2 weeks ago - I was recently diagnosed with MS. My MRI show I have had it for years now and that my first episode was when my face went numb! I could've gotten treatment - I could've avoided having nerve damage due to not treating it early! I've seen 2 specialist and they are certain it started back then and for that other doctor not to run any test on me was pure negligence. He wanted me out quick. I requested my medical records from that hospital to prove my case.

Answer

The statute of limitations in NY is 2 1/2 years from the date of malpractice or from the end of continuous treatment rendered by the party you intend to sue. It appears too much time has passed for you to file suit.
