Question

I'm suing a doctor for malpractice and we're doing a settlement to keep it out of court. I have Medicaid and I need to know if my settlement is going to affect that. I have multiple sclerosis and I can't be without health insurance and I have been unable to work for the past 8 years

Answer

You are right to be concerned. If Medicaid was billed for treatment as a result of the malpractice, they will expect to be reimbursed out of any settlement - if because of a settlement your eligibility for Medicaid is affected, you need to make this clear to your lawyer - ask them about a Trust so that money can be set aside for your future medical needs.
