Can I undo a deal an attorney made on my behalf if he didn't represent my best interest?

I was represented by an attorney after I was injured in an accident. He settled with the other party's insurance without going after my SUM insurance. The other party gave me less than what I lost in lost wages, in addition I have property damage and medical bills. I specifically asked him to get my SUM to help cover the costs but he settled without it. Can I undo his deal? If I deposit the check he gave me does that mean I accept his deal or can I deposit it and still make an additional claim?

Answer

SUM is usually only available after the full policy of the other vehicle has been tendered. You don't say if that happened - if it didn't and you already signed a Release, it's doubtful you can undo it.
